Please read the following Terms of Use (“Terms”) carefully before accessing downloadable content within MyPianist mobile software application (“Application”) Music Library (the “Service”), operated by Colla Parte Oy (“us”, “we”, or “our”).
Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all users and others who access or use the Service.
By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.
Subscriptions
A paid subscription to “MyPianist PRO” is required in order to access the complete music library with all the functionalities of the Application. We offer two auto-renewable subscriptions: “Monthly Subscription” and “Yearly Subscription”.
Subscriptions on iOS and iPadOS platforms are managed by Apple Inc.; please see Apple Media Services Terms and Conditions for the appropriate terms and conditions for your country.
Subscriptions on Android platform are managed by Google LLC; please see Google Play Terms of Service for the appropriate terms and conditions for your country.
Subscription will be charged to your Apple ID / Google Play account at the confirmation of purchase. Subscription renews automatically unless canceled at least 24 hours before the end of the current period. Apple / Google will notify you if the price of subscription changes, and if required, seek your consent to continue. You will be charged for renewal within 24 hours prior to the end of the current subscription period.
If you wish to terminate your subscription to “MyPianist PRO”, you may do so in the Manage Subscriptions section of your Apple ID / Google Play account settings. In the event that subscription is terminated for any reason, immediately following the last subscription period you will not be able to download and play any of the non-free content in the music library. You may still access the recordings you may have made of your performances of the non-free content.
Restrictions
Note that we have restricted your usage of the musical accompaniment content available through the Service:
- You may not reproduce, publish, or otherwise distribute audio content generated by the Application unless the accompaniment is a part of a musical performance with another instrument.
- You may not reproduce, publish, or otherwise distribute the graphical music scores provided by the Application.
Termination
This Agreement is effective until terminated. Your rights under this Agreement will terminate automatically if you fail to comply with any of its terms.
If you wish to terminate this Agreement, you may simply discontinue using the Service.
We reserve the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. You agree that we shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Service or any part thereof.
Governing Law
These Terms shall be governed and construed in accordance with the laws of Finland, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have had between us regarding the Service.
Changes
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access the Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you may no longer access the Service.
